Italian Provisions of Law Governing Personal Data Protection (Decree-Law 196/2003) Information to be given to interested parties as to personal data handling, processing, disclosure, and storage and to their rights thereupon pursuant to Statute 13 of the aforementioned Law
he protection of personal data in Italy is governed under Decree-Law No. 196 of 30th June 2003. The Law also provides for due information, as hereunder detailed, to be given to interested parties as to the fate of said data and of their rights thereunto.
1. SICEL S.r.l., a company incorporated under Italian Law with head-office at 19, Via Della Tecnica in ARGELATO in the Province of Bologna, area code 40050, shall be responsible and accountable for the handling of any personal data that may be freely submitted to it or required and duly requested by it.
2. Said personal data shall be used solely for:
- making out and submitting bids and offers, confirming orders, evaluating the viability of the transaction and the general business standing and solvency of the party submitting the personal data, and other pre-contractual issues;
- duly performing any agreement entered into with the party concerned;
- fulfilling obligations under law relating to any agreement entered into with the party concerned, such as book-keeping and tax obligations and the like;
- in-house statistical purposes, also in connection with the Company’s Quality System (ISO 9001), and in any case in connection with the Company’s business activity.
3. Any personal data handling, processing, storage, and transmission shall be done strictly in accordance with provisions of law, good and fair business practices, and principles of transparency, and shall be held strictly confidential and generally managed so as to ensure utmost protection of the interested party’s rights.
It is understood that data processing, printing, and storage may be performed by computer-aided means or manually, and in any case under the responsibility of the Company and solely by its employees or other trustworthy collaborators or professionals, adopting all suitable and adequate security measures thereof. More precisely, the aforementioned responsibility shall rest first and foremost with the Company’s Administrative Office, the names of the persons actually responsible being specified in a footnote hereto.
4. It is further understood that personal data may be conveyed to a third party, such as a bank, a freighting agent, a carrier, the Company’s legal counsel, or any other public and/or private body, as may be required, and that in such an event any of the foregoing shall be responsible and accountable for its part to ensure due and proper personal data management and shall be held to use said data solely for one or more of the purposes outlined above. Personal data may also be disclosed to a third party in so far as and to the extent required and envisaged by E.U. provisions, prevailing law, or administrative or judicial orders.
5. As a rule and except for cases as provided for under the foregoing point 4 above, personal data shall be held as strictly confidential and not disclosed to any third party not entitled thereof.
6. It is understood that submission of personal data to the Company for their use as outlined above is optional, but it is equally understood that failure to do so as required and requested by the Company prevents their due processing, which may hence severely and inculpably inhibit due performance of any agreement between the parties.
7. Pursuant to Statute 7 of Decree-Law 196/2003, the party submitting any personal data shall always be entitled to request the receiving party by simple and informal notification thereto and by any means whatsoever (verbal, letter, fax, electronic mail) to have said data duly updated, amended, completed, and/or deleted in case of its use in breach of the law and to have such a request promptly and duly met, it being understood that all rights relating to said data shall always rest with the party initially submitting them.
